Chase Your Sky Privacy Policy

This website (`www.chaseyoursky.com`) is owned and operated by Chase Your Sky LLC (“Chase Your Sky,” “we,” “us,” or “our”). We are committed to protecting your privacy. This Privacy Policy describes what information we collect, how we collect it, the steps we take to protect your information, and what we do with the information collected on our website. By using our website or services, you consent to the collection, use, and sharing of your information as described in this Privacy Policy. If we make changes to this Policy, those changes will be effective upon posting the updated Policy here. **Please review this Privacy Policy regularly. If you do not agree to any updates, you should discontinue using our website.

If you have difficulty using or accessing any element of this website due to a disability or other reason, please get in touch with us. We will work with you to provide the information, item, or transaction you need through an accessible communication method (such as telephone support), consistent with applicable law.

Information We Collect

Website users provide us with various types of information. This includes personal data that identifies you and non-personal data that doesn’t reveal your identity.

Personal Information

Personal Information identifies you or helps us contact you. You provide data like your name, address, email, phone number, login credentials, or payment details. This happens when you create accounts, place orders, subscribe to newsletters, or contact us.

Providing personal information remains voluntary. However, certain features require this data. Making purchases or signing up for services needs your information.

Non-Personally Identifiable Information

Non-Personal Information doesn’t personally identify you. Cookies, web beacons, and tracking technologies automatically collect site usage data.

Collection includes your IP address, browser type, and device identifiers. We also gather pages visited, browsing patterns, referring pages, exit URLs, and visit timestamps. Technical information rounds out the data we collect.

This data helps us analyze trends and administer the site. User activity tracking and demographic gathering improve our services. Combined data that makes you identifiable becomes personal information under our policy.

How We Collect Information: We collect information in several ways:

Direct Collection: You fill in forms on our site during registration, checkout, or contact. Posted content like reviews or comments also provides information. Email correspondence and other communications add to direct collection.

Automatic Collection: Navigation through the site triggers automatic data collection. Cookies remember your preferences and recognize return visits. Your IP address gets logged automatically.

Third-Party Sources: Social media logins send us certain information with your consent. Marketing partners provide referral information. Shipping agents and vendors send updated delivery information to keep our records accurate.

How We Use Your Information

The information we collect (both personal and non-personal) serves any lawful purpose, including:

Provide and Improve Services: Creating and maintaining your user account, processing and fulfilling your orders or requests, and personalizing your experience on our website happens through data analysis (for example, tailoring content and product recommendations, or analyzing site usage to enhance design and functionality).

Order Processing and Communication: Transaction processing and sending confirmations, updates, or important notices about your purchases or account (such as order confirmations, shipping notices, invoices, technical notices, or security alerts) keep you informed.

Customer Support: Your inquiries, support requests, or feedback receive prompt responses as we provide customer service.

Marketing and Promotions: Newsletters, promotions, or marketing communications that may interest you arrive only following your preferences and applicable law.  For example, if you sign up or provide your consent, we may send you periodic emails about new products, special offers, or other relevant information. (You can opt out of marketing communications as described in the Your Choices section below.)

Advertising Purposes: To present you with relevant advertisements or offers. We may use data about your visits and activities on our site to serve you targeted ads on our site or third-party sites (via ad networks or social media platforms), and to measure the effectiveness of advertising campaigns.

Analytics and Research: To perform analytics, analyze trends, and conduct research on our user base and Website usage, enabling us to improve our services and product offerings.

Business Operations:For our legitimate business purposes, such as maintaining the day-to-day operation of our website and services, fraud detection and prevention, and corporate governance (e.g., accounting, auditing, compliance).

Legal Compliance and Security:To comply with applicable laws, regulations, legal processes, or enforceable governmental requests; and to enforce our Terms of Use or other agreements. We may use your information to protect the rights, property, or safety of Chase Your Sky, our users, or others (for example, to detect and prevent fraud, security incidents, or other potentially prohibited or illegal activities).

With Your Consent: For any other purpose for which you have given your consent at the time of collection. If we request to use your personal information in a manner not described in this Policy, we will provide an explanation and, if required by law, obtain your consent.

We will not use personal information for purposes materially different from those above without updating this Privacy Policy and, if required by law, obtaining your consent.

How We Share Data

Your personal information will never be sold or rented to third parties for their direct marketing purposes without your prior consent. However, information sharing (including personal information) with third parties occurs under the following circumstances, or as otherwise described in this Privacy Policy:

Service Providers and Vendors: Trusted service providers, contractors, and affiliate companies receive information when they perform business operations or work on our behalf and require access to certain information to fulfill their duties. For example, this includes companies that assist with payment processing, order fulfillment and shipping, website hosting, data analysis, email delivery, customer service, or marketing support. These parties are authorized to use personal information only as necessary to provide services to us and are contractually obligated to protect it.

Business Partners and Affiliates: Information sharing with business partners or affiliates happens when we jointly offer products or services, or work with joint marketing partners. For instance, if we run a co-sponsored promotion or collaboration, information collected for that event may be shared with our partner (we will disclose this at the time of collection). Similarly, we may share your mailing address or email with a partner to send you information about their products or services that may interest you, provided you have consented to or not opted out of such communications

Advertising and Analytics Partners: We may allow third-party advertising networks or analytics providers to collect non-personal information about your browsing behavior through cookies and other technologies on our site (see Cookies and Tracking below). We share limited personal data (such as device identifiers or demographic segments) with these partners to help deliver targeted advertisements or measure site traffic and usage. Any such sharing for advertising purposes is done in accordance with applicable law (for example, if required, we will obtain your opt-in consent for the use of cookies).

Corporate Transactions: If Chase Your Sky LLC is involved in a corporate transaction such as a merger, acquisition, reorganization, financing, or sale of all or a portion of our business or assets, or the unlikely event of bankruptcy or insolvency, your information may be disclosed to prospective or actual purchasers or other parties involved in the transaction as part of due diligence or transferred assets. In such cases, we will seek to ensure the recipient of the data honors the commitments we have made in this Privacy Policy.

Legal Requirements and Protection of Rights: We may disclose your information when we believe in good faith that such disclosure is necessary to comply with a legal obligation or request (such as a law, regulation, search warrant, subpoena, court order, or government demand). We may also share information if we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of others, or violations of our Terms of Use or other agreements or policies. This could include exchanging information with law enforcement or other companies and organizations for the purpose of fraud protection and credit risk reduction.

With Your Consent or At Your Direction: We may share your personal information with third parties when you direct us to do so or when you have expressly consented to the sharing. For example, if you opt in to a feature that requires sharing your information with a third party, we will do so under the conditions described at the time of opt-in.

Beyond the situations above, any anonymized or aggregated data (information that can no longer be linked to you personally) may be shared with third parties for any lawful purpose without limitation. For instance, we might share aggregated usage statistics or survey results that do not identify any individual.

Cookies and Tracking Technologies

We use cookies and similar tracking technologies to automatically collect information about your device and interactions with our site over time. Cookies are small text files placed on your browser or device that help us recognize you and remember your preferences. Web beacons (also known as pixel tags) are tiny graphics embedded on webpages or emails that are used to monitor your activity. These technologies enable us to, for example, keep you logged in, remember your settings, and collect analytics data on how users navigate the site. They also help us serve interest-based advertisements by understanding which pages or products you viewed.

We (and authorized third parties) may use cookies to:

Enhance Site Functionality: Cookies facilitate basic site features, such as shopping cart functionality, user authentication, and loading preferences (e.g., language or region selection).

Analytics: We use analytics cookies and tools (such as Google Analytics) to collect information about site traffic and usage. These tools collect information, such as page requests, time spent on pages, and links clicked. This data helps us improve our website and marketing campaigns.

Advertising: We partner with advertising networks that use cookies and similar tech to deliver targeted ads on our behalf on other sites. These cookies remember whether you’ve visited our site and what your interests might be, which allows advertising companies to show you ads relevant to Chase Your Sky products that you may be interested in.

Your choices for cookies: Most web browsers automatically accept cookies. Still, you can usually modify your browser settings to decline cookies or receive an alert when a cookie is being placed. Please note that if you disable or delete cookies, some parts of our site might not function properly (for example, you might not be able to complete an order or use certain interactive features). For more information about managing cookies, refer to your browser’s help documentation. We also comply with any specific cookie consent requirements mandated by applicable law (for example, if you are in the EU/EEA, you will be shown a cookie consent banner as required).

Do Not Track: Some browsers offer a “Do Not Track” (DNT) setting that allows you to signal a preference not to be tracked across websites. Currently, there is no uniform industry standard for recognizing or honoring Do Not Track (DNT) signals. As a result, we do not respond to Do Not Track signals or similar mechanisms at this time. If you do not wish to be tracked via cookies, we recommend disabling cookies in your browser (as described above), which can limit some tracking; however, note that this may affect site functionality. We will update this section if a standard for responding to DNT signals is established in the future and we are required to follow it.

Data Security

We take the security of your personal information seriously. Chase Your Sky implements reasonable and appropriate technical and organizational measures to protect your information from unauthorized access, loss, misuse, alteration, or destruction. These safeguards include measures such as encryption of sensitive data (for instance, we use SSL/TLS protocols to encrypt information transmitted between your browser and our website), firewalls, secure server infrastructure, and internal policies to limit access to personal data on a need-to-know basis. We also require our service providers to protect the confidentiality and security of the personal information they handle on our behalf.

However, no method of transmission over the Internet or electronic storage is entirely secure. While we strive to protect your personal information, we cannot guarantee its absolute security. You should also take care when handling and disclosing your personal information and login credentials, and avoid sending sensitive information through insecure channels. In the event of a data breach that affects your personal information, we will notify you and the relevant authorities as required by law.

Limitation of Liability: To the fullest extent permitted by law, Chase Your Sky LLC will not be liable for any loss or damage arising from unauthorized access to or misuse of your personal information that is beyond our reasonable control. By using our site, you understand and agree that you are doing so at your own risk and that we are providing our site and services “as is” without any express or implied warranty regarding the security of your data.

Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, as described in this Privacy Policy, unless a more extended retention period is required or permitted by law. For example, we may retain specific transaction details for accounting or legal compliance purposes, and we may keep your contact information as long as you maintain an account with us or until you request deletion.

When we have no ongoing legitimate business need to process your personal information, we will either delete it, anonymize it, or, if deletion or anonymization is not feasible (for example, because the information has been stored in backup archives), securely store the information and isolate it from further use. We also routinely delete or anonymize unnecessary data as part of our data hygiene practices.

Please note that even after you request deletion of your personal information, we may retain some info as required by law (for example, for tax, audit, or legal compliance), or for legitimate business purposes (such as security, fraud prevention, or ensuring continuity of our services) to the extent permitted by law. In all such cases, we continue to protect that information in accordance with this Policy.

Third-Party Links and Tools

Our website may contain links to third-party websites or integrate third-party services and tools (such as social media widgets or payment processors) that are not operated by Chase Your Sky. Please be aware that this Privacy Policy does not apply to information collected on any third-party website or service that we do not control. If you click on a link to an external site or interact with a third-party service, that third party may collect your data independently, and their privacy policy will apply. We are not responsible for the privacy practices, security, or content of external websites or services.

We strongly encourage you to review the privacy policies of any third-party websites you visit or services you use. You provide personal information to third-party sites at your own risk. This includes any social media platforms or other sites that are linked from our website. Choose to share information from our site (for example, by clicking a “share” button to post content to a social network). That activity may be visible to others and governed by the platform’s privacy policy.

Children's Privacy

Our website and services are not intended for children under 13 years of age. We do not knowingly collect personal information from anyone under 13. If you are under 13, please do not use or provide any information on this website. Chase Your Sky does not direct its content or offerings to children, and we do not knowingly contact or engage with children under the age of 13. If we learn that we have collected personal information from a child under 13 without parental consent, we will promptly delete that information from our records.

If you believe we may have information from or about a child under 13, please get in touch with us immediately at info@chaseyoursky.com so that we can take the appropriate action. Parents or legal guardians should contact us if they have any concerns regarding the collection or use of their children’s personal information.

Note: Residents of certain jurisdictions may have additional protections under local law. For example, the United States Children’s Online Privacy Protection Act (COPPA) imposes requirements on websites that collect personal information about children under 13. Chase Your Sky complies with COPPA and similar laws. Since we do not knowingly collect such information, we do not maintain data about children under 13. For minors aged 13–16, if required by applicable law (such as specific provisions of the California Privacy Rights Act), we will not sell or share the personal information of minors unless they (or their parent or guardian, as appropriate) have affirmatively authorized it.

Your Choices

You have certain choices about how we communicate with you and how we handle specific information.

Account Information:

If you have an account with us, you can review and update some of your personal information (such as your name, contact details, and login credentials) by logging into your account profile page. Please keep your information up to date. If you need to update any other information or experience trouble with your data, please get in touch with us for assistance.

Marketing Communications:

You may opt out of receiving promotional emails from us at any time. To unsubscribe, follow the instructions provided in those emails (usually an “unsubscribe” link at the bottom of the email) or send us a request at info@chaseyoursky.com. Even if you opt out of marketing messages, we may still send you transactional or relationship communications (e.g., emails about your orders, account notifications, or customer service matters) that are necessary for us to fulfill our responsibilities to you.

Cookies:

As described in the Cookies and Tracking section, you have the ability to control or limit the use of cookies through your browser settings. You can also opt out of specific third-party cookie uses (such as Google Analytics) by using the tools those third parties offer (e.g., Google’s opt-out browser add-on). Please note that opting out of cookies may affect your user experience on our site.

Do Not Track:

We have explained our approach to Do Not Track signals in the section above. While we currently do not respond to DNT browser signals, you can take steps to limit tracking by adjusting cookie settings as noted. We will update you if our policy on DNT changes.

Modifying or Deleting Your Information:

If you would like to review, correct, or delete personal information that you have previously provided to us, please get in touch with us at info@chaseyoursky.com. We will respond to your request in accordance with applicable laws and regulations.  Please note that we may not be able to accommodate every request to change or delete information; for example, we may retain specific data if required by law or for legitimate business purposes (as described in the Data Retention section). If you request deletion of your data, it may take some time to fully remove your information from our systems and backups. We may also ask you for additional information to verify your identity before processing your request, as a security precaution.

Your Privacy Rights

Depending on your jurisdiction, you may have specific legal rights regarding your personal information. Chase Your Sky is committed to complying with applicable data privacy laws and has established processes to honor these rights.

California Privacy Rights

If you are a California resident, you are entitled to certain rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), subject to certain exceptions. These rights include:

Right to Know: You have the right to request that we disclose what personal information we collect, use, disclose, and sell or share (if applicable) about you. This includes the categories of personal information we have collected, the categories of sources from which we collect this information, our business purpose for collecting or sharing the information, the categories of third parties with whom we share the information, and the specific pieces of personal information we hold about you. You may request a copy of the personal data we have about you from the past 12 months.

Right to Delete: You have the right to request the deletion of personal information we have collected from you and retained, subject to certain exceptions (for example, we may retain information needed to complete a transaction you requested, to detect security incidents, or for legal compliance purposes).

Right to Opt-Out of Sale or Sharing: You have the right to opt out of the sale of your personal information. Chase Your Sky does not currently sell personal information for monetary value.  If we ever engage in activities that are considered a “sale” or “sharing” under California law (such as sharing information for cross-context behavioral advertising), we will provide a straightforward method for you to opt out.

Right to Correct: Effective January 1, 2023 (under CPRA), California residents also have the right to request correction of inaccurate personal information maintained about them. If you believe any of the information we have about you is incorrect, please notify us so we can make the necessary corrections.

Right to Non-Discrimination: We will not discriminate against you for exercising any of your rights under the CCPA. This means we will not deny you our services, charge you a different price, or provide a different level of service quality solely because you have exercised your privacy rights. (However, please note that if the exercise of your rights limits our ability to process personal information — for example, if you request deletion of all your data — we may not be able to provide you certain services that rely on that information.)

To exercise any of these California rights, you (or an authorized agent acting on your behalf) can submit a request to us using the contact information in the Contact Us section below. We will need to verify your identity (and, if applicable, your authority through an agent) before processing specific requests, which may require you to provide additional information. California law also permits California residents to request specific details about what personal information we share with third parties for those third parties’ direct marketing purposes. Chase Your Sky’s policy is not to share personal information with third parties for their own direct marketing purposes without your consent, as stated above.

European and International Data Subject Rights

Suppose you are located in the European Economic Area (EEA), the United Kingdom, or another jurisdiction with similar data protection laws. In that case, you may have the following rights under the General Data Protection Regulation (GDPR) or applicable local law:

Right to Be Informed: You have the right to receive clear and transparent information about how we use your personal data, which is the purpose of this Privacy Policy.

Right of Access: You can request information about what personal data we have about you and obtain a copy of that data.

Right to Rectification: If any of your personal data is inaccurate or incomplete, you have the right to request correction or completion.

Right to Erasure (Right to Be Forgotten): You have the right to ask us to delete your personal data when it is no longer necessary for the purposes for which it was collected, or when you withdraw consent (if our legal basis was consent), or when we have processed your data unlawfully, among other reasons. This right is not absolute – sometimes we may have legal grounds to retain data (e.g., a legal obligation or a compelling legitimate interest).

Right to Restrict Processing: You can request that we limit the processing of your personal data in certain circumstances, such as while we are verifying the accuracy of your data or assessing an erasure request.

Right to Data Portability: You have the right to obtain your personal data in a structured, commonly used, machine-readable format and to have that data transferred to another controller where technically feasible, when the processing is based on your consent or a contract you have with us.

Right to Object: You may object to our processing of your personal data when that processing is based on our legitimate interests, including for direct marketing purposes. If you object, we will stop processing your information unless we have compelling legitimate grounds to continue or as otherwise permitted by law. If your objection is to direct marketing, we will honor it absolutely (i.e., we will stop using your data for marketing purposes).

Rights related to Automated Decision-Making: You have the right not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects or similarly significant effects on you, without human intervention, except as permitted by law. (Note: Chase Your Sky does not generally use automated decision-making without human involvement in a way that has significant effects on individuals.)

Right to Withdraw Consent: If we rely on your consent to process personal data, you have the right to withdraw that consent at any time. Withdrawal of consent will not affect the lawfulness of processing conducted based on consent before its withdrawal.

Right to Complain: You have the right to lodge a complaint with a data protection authority (such as your local supervisory authority in the EU, or the Information Commissioner’s Office in the UK) if you believe we have infringed your privacy rights. We would, however, appreciate the opportunity to address your concerns before you do so. Please consider contacting us first so we can try to assist you.

To exercise your rights under the GDPR or other applicable privacy laws, please get in touch with us (see Contact Us below). We may request proof of identity to verify and process your request. We will respond to your requests within the timeframes required by law (generally within one month for GDPR requests, which may be extended by an additional two months in certain circumstances). These rights may be subject to limitations and exceptions under applicable law.

Changes to This Privacy Policy

We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other reasons. When we do, we will post the updated policy on this page with a new effective date. Any changes will take effect upon posting, unless otherwise required by applicable law. If the changes are significant, we may also notify you by additional means, such as sending an email notice to you (if we have your email address) or by placing a prominent notice on our website.

It is your responsibility to review this Privacy Policy periodically for updates. Your continued use of our website following the posting of changes constitutes your acceptance of such changes to the extent permitted by law. If you do not agree to the revised terms, you should stop using the site and services.
